Nájemní smlouva/podnájem

mám dotaz k zadávání veřejných zakázek, dle paragrafu 29, není zadavatel povinen zadávat v zadávacím řízení v případě nájmu existující nemovitosti. Lze tuto výjimku aplikovat i na situaci, kdy se nebude jednat o nájem ale o podnájem? Zadavatel bude v postavení podnajemce.

S ohledem na skutečnost, že podnájem je systematicky v občanském zákoníku zařazen do části čtvrté, hlavy druhé, oddíl 3 – nájem, vztahuje se tak předmětná výjimka i na podnájem nemovitosti.
